1. Acceptance of Terms

By creating an account, downloading the app, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Himcules is a personal tracking application designed to help users log testosterone replacement therapy (TRT) injections, manage schedules, and set reminders. The Service is for entertainment and personal organization purposes only.

3. User Responsibility

You are solely responsible for:

  • Following your healthcare provider's prescribed treatment plan
  • Ensuring the accuracy of any information you enter into the app
  • Making your own healthcare decisions in consultation with qualified professionals
  • Using the app as a personal tracking tool, NOT as medical guidance
  • All activities that occur under your account

4. Eligibility

You must be at least 13 years of age (or 16 in the EEA) to use this Service. If between 13 and 18, you must have permission from a parent or guardian.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties including MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, and NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

6. Limitation of Liability

NO LIABILITY FOR HEALTH OUTCOMES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIMCULES SHALL NOT BE LIABLE FOR ANY HEALTH OUTCOMES, MEDICAL COMPLICATIONS, OR ADVERSE EFFECTS RELATED TO YOUR USE OF THE SERVICE OR ANY DECISIONS YOU MAKE BASED ON INFORMATION TRACKED IN THE APP.

IN NO EVENT SHALL HIMCULES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS GREATER.

7. Indemnification

You agree to defend, indemnify, and hold harmless Himcules and its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

8. Class Action Waiver

YOU AGREE THAT ANY CLAIMS WILL BE BROUGHT ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

9. Governing Law

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration. Any cause of action must be commenced within one (1) year after it accrues.

10. Termination

We may terminate or suspend your access immediately, without prior notice, for any reason including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of the new Terms.
